City Burning Permit

Outdoor Burning Regulations
  • Commercial outdoor fireplaces are permitted under the following conditions:
    • Not used within 20 feet of any structure, roadway, or alley.
    • Continually attended by a competent adult.
    • Must have an appropriate extinguishing agent nearby, such as a garden hose or a fire extinguisher [4-A rating].
    • Only clean, seasoned firewood may be used.
    • Outdoor fireplaces must be used as intended, with all screens in place, and secured to prevent being knocked over.
  • Self-constructed fire pits may be approved if contained with ½” spark arrestor screen or mesh.  Only clean, seasoned firewood may be used.
  • No open burning is permitted within 90 feet of any structure, roadway, or alley.
  • No outdoor burning may last more than three hours.
  • No fuel area shall be greater than 3’ in diameter, nor 2’ in height
  • A permit must be obtained from the Athens Fire Department for any open burning beyond the 90 feet limit.
